Talk to Santa products or services are owned by Talk to Santa or its licensors.
These trademarks and service marks may be registered in the United States and internationally.
Software made available on the TTS Sites is copyrighted by Talk to Santa and/or our suppliers. Use of such software is governed by our Terms of Use and any applicable end-user license agreements.
Certain notices and disclaimers applicable to U.S. Government users appear in agreements with our licensors and suppliers. These notices form an integral part of this Agreement.
Any use, duplication, or disclosure of the software by the United States Government is subject to the restrictions in DFARS 252.227-7013(c)(1)(ii) and FAR 52.227-19.
"User Materials" means content uploaded, submitted, or distributed by users via the TTS Sites, excluding all TTS-owned content. Talk to Santa complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, and responds to valid infringement notices.

A physical or electronic signature of the copyright owner or authorized agent;
Identification of the copyrighted work claimed to be infringed;
Identification of the material claimed to be infringing and its location on the site;
Contact information of the complaining party;
A good-faith statement that the use is not authorized by the copyright holder;
A sworn statement, under penalty of perjury, that the notice is accurate and the filer is authorized.If your material was removed because of a DMCA complaint, you may file a counter-notification including:
Your physical or electronic signature;
Identification of the removed material and its previous location;
A sworn statement that the removal was due to mistake or misidentification;
Your name, address, phone number, and consent to Federal District Court jurisdiction.Upon receipt of a valid counter-notification, Talk to Santa may reinstate the removed material as allowed by the DMCA.
Under DMCA §512(f), anyone who knowingly misrepresents infringement—or knowingly misrepresents that material was removed in error—may be held liable for damages, including attorneys’ fees.
Users determined by Talk to Santa, in its sole discretion, to be repeat infringers will have their accounts terminated and will be prohibited from creating new accounts.
