This Privacy Policy applies to your use of all websites, mobile applications, and products or services owned or operated by North Pole Communications, LLC dba Talk to Santa (“TTS”), including TalkToSanta.com and all related applications and services (collectively, the “TTS Sites”).

This Privacy Policy is an integral part of the agreement between Talk to Santa (“TTS,” “we,” or “us”) and each Visitor, Registered User, Live Call Purchaser or Member (“you”). This Policy works together with our Terms of Service, Terms of Sale, and our Legal Notices.

By submitting personal information on any TTS Site or through any TTS Service, you consent to this Privacy Policy and agree that your information may be collected, stored, processed, and transferred to the United States.

Your California Privacy Rights

California Civil Code Section 1798.83 (“Shine the Light” law) allows California residents to request certain information about disclosure of their personal information to third parties for direct marketing purposes.

A published privacy policy explaining opt-in or opt-out choices.
A cost-free mechanism to exercise those rights.

California residents may request disclosure via email at: elfsupport@talktosanta.com. We only respond to one request per year per resident.

Do Not Track Disclosure: TTS Sites do not currently respond to browser “Do Not Track” signals.

Information Collection and Use

TTS collects information such as name, email address, age, and profile details to enrich user experience, enable account creation, support messaging, and facilitate services like live calls or video messages.

We may record IP addresses, browser type, device data, and analytics data to manage and improve the TTS Sites. Some of this information may be shared with trusted third parties to provide relevant content or ads.

Your email address is used to communicate with you regarding updates, purchases, account notices, or marketing messages. You may opt out at any time.

By using our services, you agree to receive SMS messages for marketing and transactional purposes. Message frequency may vary. Standard carrier rates apply.

Use of Cookies & Similar Technologies

TTS uses cookies, Flash cookies, and Web Beacons to store preferences, manage sessions, track usage, and customize content. You may limit some cookies via browser settings, but Flash cookies require separate controls.

Users may send invitations via email or third-party single sign-on services. Email addresses used for invitations are not sold and are only used for the intended notification.

Service Providers

We use trusted third-party vendors for services such as payments, shipping, data storage, security, and subscription management. These providers are granted access only as needed to perform required tasks.

Third-Party Sites

TTS Sites contain links to third-party websites. Their privacy policies govern your use of those sites, not ours. Always review third-party privacy policies before submitting information.

Security

User accounts are protected by passwords and, in some cases, third-party authentication. Although we use commercially reasonable safeguards, no system is completely secure.

In the event of a security breach, we may notify you by email or other communication methods as required by law.

Data Deletion Request Addendum

To comply with Facebook’s platform rules, users may request deletion of their data by emailing: privacy@talktosanta.com with the subject line “Data Deletion Request.”

We may require verification before processing the request.

Sharing & Disclosure

TTS may disclose personal information only when legally required, to enforce our rights, to protect safety, or in emergency situations.

Personal information may also be transferred to a successor in interest in the event of a merger, acquisition, or asset sale.

Children’s Privacy

TTS does not knowingly collect personal information from children under 13. Parents must create accounts and supervise children’s interactions on the TTS Sites.

Changes in Our Privacy Policy

TTS may update this Privacy Policy from time to time. Material changes will be posted on affected TTS Sites, and registered users may be notified via email.
